Is Delta 8 THC legal?

Federally, yes. Thanks to Section 10113 of the 2018 Farm Bill, any and all Hemp derivatives that contain 0.3% or less of Delta 9 THC are legal on the federal level in the United States.
 
However, certain states have elected to put a ban on Delta 8 products in their own jurisdictions. These states include: Alaska, Arizona, Arkansas, Colorado, Connecticut, Delaware, Kentucky, Idaho, Iowa, Michigan, Mississippi, Montana, New York, North Dakota, Rhode Island, Utah, Vermont, Washington. Be sure to stay up to date on your local and State laws.
